Working in the brand protection area on TM and IP, we tackle different expressions of plagiarism. It is an unauthorized appropriation of text, idea,technologyand the representation as one's own original work. At this time it is frequent in several area of the business.

Cryptomnesia

According to Wikipedia - "C" occurs when a forgotten memory returns without it being recognized as such by the subject, who believes it is something new and original.

IOW: It is a memory bias whereby a person may falsely recall generating a thought, an idea, a tune, or a joke, not deliberately engaging in plagiarism but rather experiencing a memory as if it were a new inspiration.

Any thoughts?

Examinations, reports, papers, articles and books are ways competence is established in society. They provide the means by which people have access to skilled jobs and the means by which people enter the professions: doctors, lawyers, engineers, educators, etc.

Plagiarism represents the competence of an individual when that competence -- that thought, those words -- actually belong to another. It contributes to the false impression of the knowledge, skills and abilities of an individual in the quest of a skilled or professional role in society.

It is not possible for each and every one of us to develop the knowledge of disease prevention and treatment, so we give the task to doctors. This is true of many, many walks of life -- including engineers, judges, teachers, plumbers and electricians. Society gives a social warrant to an individual when that person is deemed to have the competence to be a lawyer, a doctor, an electrician, etc.

Plagiarism erodes and destroys the social warrant and causes us to question of ability of professionals. We make the assumption that a few bad apples makes for a barrel of bad apples -- that all members of a professional group -- be they lawyers, journalists or politicians -- are inherent corrupt or incompetent.

Therefore, it is incumbent that those charged with evaluating exams, tests, reports, and manuscripts give focus and energy to mitigating plagiarism and using tools available to do so.
